Purchase Terms and Conditions
1. Parties
When purchasing a puppy from us you agree to the below terms and conditions. This applies to all Gumtree, Rightpaw and website sales.
2. Health Guarantee

The Seller guarantees that the puppy is in good health at the time of sale, to the best of their knowledge.

The puppy has received age-appropriate vaccinations and deworming treatments, as documented in the provided health records.

The Buyer must have the puppy examined by a licensed veterinarian within 48 of receipt. If the veterinarian finds a significant health issue that existed prior to sale, the Buyer may return the puppy for a full refund or exchange for another puppy of equal value, subject to availability, provided the Seller is notified within 1 day of the examination.

This health guarantee does not cover minor or treatable conditions, accidents, or illnesses arising after the sale due to Buyer negligence.
3. Return Policy and Deposit Surrender Fee

If the Buyer chooses to return the puppy for any reason other than a significant health issue (as outlined in Section 3), the Buyer must notify the Seller immediately and returns will only be accepted ander extenuating circumstances. If accepted, upon return of the puppy in good health and condition, the Seller will refund the purchase price, less a non-refundable deposit surrender fee of $500, which covers administrative costs, re-homing efforts, and care provided to the puppy.

The puppy must be returned with all original documentation, including health records and microchip information.

Return shipping or transportation costs are the responsibility of the Buyer.

No refunds will be issued if the puppy is returned in poor health or condition due to Buyer neglect.
6. Buyer Responsibilities

The Buyer agrees to provide the puppy with proper care, including adequate food, water, shelter, veterinary care, and a safe environment.

The Buyer will ensure the puppy is registered with local authorities and complies with all applicable laws (e.g., licensing, leash laws).

The Buyer agrees not to sell, transfer, or abandon the puppy without first notifying the Seller. The Seller retains the right of first refusal if the Buyer can no longer keep the puppy.
7. Seller Responsibilities

The Seller will provide the Buyer with the puppy’s health records, vaccination history, and any applicable registration papers (e.g., pedigree or microchip transfer).

The Seller will disclose any known health or behavioural issues prior to sale.

The Seller is not responsible for veterinary costs, training, or other expenses incurred after the sale, except as outlined in Section 2.
8. Non-Breeding Clause

Unless explicitly agreed in a separate breeding contract, the puppy is sold as a pet only and may not be used for breeding purposes.
9. Limitation of Liability

The Seller is not liable for any damages, including but not limited to veterinary costs, property damage, or personal injury caused by the puppy after the sale.
10. Dispute Resolution

Any disputes arising from this agreement will be resolved through mediation or arbitration in Queensland, Australia.

Both parties agree to cover their own legal fees unless otherwise determined by a mediator or arbitrator.
11. Entire Agreement
-
The above terms and conditions constitutes the entire agreement between the Seller and Buyer and supersedes any prior verbal or written agreements.
